Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and PVS Assisted Living Inc. (PVS Living, we, us, or our) concerning your access to and use of our website, services, and products.

Payment and Billing

Limitation of Liability

To the maximum extent permitted by law, PVS Living and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services.

Our total liability for any claims arising from or related to our services shall not exceed the amount you paid us in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless PVS Living and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of our services
Your violation of these Terms
Your violation of any rights of third parties
Your violation of applicable laws or regulations

Termination

We may terminate or suspend your access to our services immediately, without prior notice, for any reason, including if you breach these Terms.

You may terminate your account at any time by contacting us. Upon termination, your right to use our services will immediately cease.

These Terms, together with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and PVS Living regarding our services.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or government actions.
